Highlights of Faculty Task Force Recommendations : Layoff and Recall
- Create a policy section, specifying layoff guidelines and procedures that are in accord with AAUP principles.
- Make explicit that layoffs can be made only for reasons of financial exigency or formal discontinuance of a program or department.
- Provide for the participation of the Faculty Senate in layoff decisions, requiring that the Faculty Senate must verify the legitimacy of any layoffs and must be consulted about what layoffs would best preserve the academic integrity of the university.
- Guarantee that faculty who believe they are being laid off improperly have the right to a formal appeal hearing before a duly constituted special committee elected by the Faculty Senate.
- Mandate that in cases involving department or program termination, layoff decisions shall be based entirely upon educational considerations that protect the long-range educational mission of the university as a whole.
- Mandate that in cases involving department or program termination, the Board of Trustees will make every effort to place affected faculty in comparable positions, or, failing that, provide equitable severance pay.
- Require that in the case of layoffs because of financial exigency, the Board of Trustees may not make new appointments until all laid-off faculty have been offered reinstatement.
- Prohibit the hiring of adjuncts to replace faculty who have been laid off.
